Students access SchoolTalk through accounts created by their School. The School is responsible for ensuring that any parental or legal guardian consent or authorisation required under applicable law has been obtained before a student is given access to the Service, consistent with the School's obligations under the Terms of Service. Parents and legal guardians who are given their own direct access to the Service — for example, to view progress reports or communicate with teachers — agree to be bound by these Terms in respect of their own use of the Service.
1. General Terms of Use for All Users
You will keep your login details confidential and are responsible for all activity on your account.
You will only access parts of the Service you have been authorised to access.
You will not attempt to copy, reverse-engineer, or build a competing product from the Service.
You will not upload or transmit content that is intended to bully, harass, or intimidate another user; is false, defamatory, or abusive; or contains viruses or other harmful code.
You understand SchoolTalk includes AI-generated content (see Section 5) and that this supports, but does not replace, your teachers' or school's professional judgement.
You will comply with all applicable laws, including the New Zealand Privacy Act 2020 and, where applicable, the Australian Privacy Principles under the Privacy Act 1988 (Cth).
Progressify may modify, suspend, or discontinue features of the Service with reasonable notice, and will not be liable for such changes except as set out in the Terms of Service.
2. Terms of Use for Teachers and School Administrators
You are accessing the Service on behalf of your School and in accordance with the School's Subscription Agreement with Progressify.
You will use the Service responsibly and for its intended educational purpose, and take reasonable steps to ensure students in your care do the same.
You will respect the privacy of all users; content relating to a specific student should not be shared with users who do not have a legitimate need to see it.
You understand that where your School has consented to AI Features, SchoolTalk sends only anonymised academic data (no learner names, IDs, or other identifiers) to the AI service, as described in Progressify's AI Policy.
If you administer AI-generated progress summaries, you remain responsible for reviewing their accuracy before sharing them with parents or using them in formal reporting.
If you are an Administrator, you are responsible for managing user access correctly, including promptly removing access for students or staff who leave the School.
3. Terms of Use for Students
This section reflects SchoolTalk's Code of Conduct and applies to student use of the Service.
Please do not use SchoolTalk until you have read and talked about these Terms and the Privacy Policy with your teacher, parent, legal guardian, or caregiver.
Please do not tell anyone else your password. If someone else finds out your password, change it straight away.
You must only access your own SchoolTalk account — please do not access anyone else's account, including other students, parents, or teachers.
You are responsible for everything that happens on your SchoolTalk account.
Please do not post anything on SchoolTalk that is intended to bully or annoy someone else, is unacceptable for school, is untrue, unkind, or abusive.
If you find something mean or inappropriate on SchoolTalk, please tell your teacher, parent, or caregiver straight away.
Some of the progress information you see is written by an AI tool based on your schoolwork. It's there to help describe your progress in plain language — your teacher is always the one who knows your learning best.
4. Terms of Use for Parents and Legal Guardians
Your child's School is responsible for authorising your child's access to SchoolTalk and for obtaining any consent required from you under applicable law before doing so. If you have questions about that process, please contact your School directly.
If you are given your own direct access to SchoolTalk — for example, to view your child's progress reports or communicate with teachers — you agree to be bound by these Terms in respect of your own use of the Service.
You may be shown AI-generated progress summaries about your child's learning. These summaries are generated from anonymised academic data only — no learner names or identifying information are sent to the AI service that produces them — and are intended to support, not replace, communication with your child's teacher.
You can ask your School or Progressify questions about how SchoolTalk handles your child's data at any time, including whether AI Features are enabled for your School.
You understand and agree that the School and/or Progressify may send you communications relevant to your child's use of the Service, including via email or in-app notification.
5. AI-Generated Content
SchoolTalk's AI Progress Summary feature is only enabled for a School after that School has received notice and provided consent. It uses anonymised academic data to generate short descriptive summaries of a learner's progress, available in English or Te Reo Māori. It does not evaluate or make judgements about individual learners, does not make predictions about future performance, and does not store information that could identify a learner. 6. Restricted Content
You will not upload, post, or transmit content that: uses another person's information or image without consent; harasses, bullies, or humiliates another person; contains hate speech, violent, or graphic content; is intended to deceive or mislead; contains viruses or other harmful code; or otherwise violates applicable law. Progressify may remove or restrict access to content that breaches this section.
7. Intellectual Property
Progressify owns all Intellectual Property Rights in the Service. You retain ownership of content you create on SchoolTalk (such as learner work and portfolios), subject to the licence you grant Progressify to host and display that content as needed to provide the Service.
8. Compliance and Certifications
SchoolTalk is assessed under the ST4S (Safer Technologies for Schools) certification programme. Progressify will notify schools of material changes to how student data is processed, including changes to AI Features, and will seek consent before such changes take effect.
9. Child Protection
Progressify maintains a Child Protection Policy addressing the identification and reporting of child abuse or neglect, and the safety checking of staff whose role involves relevant contact with children, consistent with the Children's Act 2014. 10. Grievances and Complaints
If you have a concern about your use of the Service, content posted by another user, or how these Terms have been applied, please contact support@progressify.io. Please include your name, your role (student/teacher/parent/administrator), your School, and a description of the issue so we can respond promptly.
11. Changes to These Terms
Progressify may update these Terms from time to time. Material changes will be notified to Schools and, where required, users will be asked to accept the updated Terms before continuing to use the Service.
12. Governing Law
These Terms are governed by the laws of New Zealand. Any dispute will be subject to the jurisdiction of the New Zealand courts, without limiting any rights a School or user may have under Australian law where applicable.
